A lot of people are trying to predict what is going to happen on November 3rd. For clarity the polls should be taken seriously, but not literally. Bearing in mind that note of caution, these are — the best — polls I have ever seen for the Democratic party heading into federal election. It doesn’t get any better from a polling standpoint. But that alone does not equate to a changing of the guard in Congress.

Clearly Trump and his entourage are trying to sow doubt, fear and confusion about the upcoming voting process. One tool they are using is litigation. With a plethora of legal actions filed in all 50 states and the District of Colombia. According to CBS News, “As of October 2026, the Trump administration has filed legal actions against nearly all 50 states seeking voter data, with lawsuits against 30 states and the District of Columbia specifically aimed at obtaining unredacted voter registration lists.”

The Trump administration has no reason to have faith in the US courts. They are on an epic losing streak in state and district courts across the nation and there should be little expectation that the current round of lawfare will be any more successful. But there is one court where they continue to enjoy success, the United States Supreme court. Where no other court will tolerate the Trump administrations’s badly flawed legal arguments SCOTUS somehow finds a way to create novel grounds to further their objectives.

If you are looking for a rationale, a strategy for the Trump DoJ filing legal actions that appear destined to fail at the state and district court level the answer might be the prospect of Supreme Court intervention at the end of the rainbow. The game plan may be to file as many actions as possible in the lower courts and push some or all of them to the only court where they have a chance, the Supreme court.

Time is short now so the discussion must turn to to what the average citizen can do to make a difference. In a word vote. There are those who do not want you to vote and they make their intentions very clear. Your mindset must be not only will I vote, but to the bigger point, “they can’t stop me from voting.” That’s the level of determination this moment requires. That is what it took to overthrow by electoral means the corrupt autocratic regimes in Hungary (Viktor Orbán), Serbia (Aleksandar Vučić) and reject a the return of the Bolsonaro dynasty to power in Brazil.

The Trump regime is also corrupt and autocratic and that kind of leadership dynamic does not go quietly as the result of an orderly democratic election. They are determined to hold on the power at all costs. What this moment demands is a greater effort. The painful truth is that in many US elections a large segment of eligible American voters simply don’t come out. This would be the wrong time to try that.

You cannot go to court and fight the legal battles or prevent the DoJ from doing what they intend to do. But you can be a part of a wave that turns the tide against the corruption that grips our nation. A wave, a real wave is needed. Good enough won’t be good enough this time. A great effort is needed by every eligible voter in the America. The time is now, right now. Make you voice heard so that you will continue to have a voice.
